HiO Golf Ltd – Hole In One Skill : OFFICIAL RULES OF THE Contest

These terms and conditions constitute the Official Rules that govern the HiO Golf Limited’s Hole in One Skill Contest (the “Skill Contest”) and any player who registers to play in the Contest (“you” or a “Participant”). 

IMPORTANT! By entering, you agree to be bound by both these Official Rules and our Privacy Policy https://hiogolf.com/hio-golf-limited-privacy-policy/. IF YOU DO NOT AGREE TO BE BOUND BY THESE OFFICIAL RULES AND PRIVACY POLICY, DO NOT ENTER the HiO Golf Ltd Hole in One Skill Contest.

In the event of a conflict between these Official Rules and any marketing materials published by HiO Golf Ltd and/or any representations made by any party other than HiO Golf Ltd, including but not limited to any participating golf course or their employees, these Official Rules will take precedence.

  1. The Sponsor and the Website
    1. The sponsor is HiO Golf Ltd, a company incorporated in England and Wales with Company Number 15363342 and whose registered office is 49 Winkworth Road, Banstead, Surrey United Kingdom, SM7 2QJ (the “Sponsor”)
    2. The Sponsor operates the website www.hiogolf.com (the “Website”) and also operates the Skill Contest. 
    3. Sponsor may change these Official Rules at any time; if the Official Rules are changed, details of the changes made will be listed below this clause where the Official Rules are printed on the Website.  Each Participant should check the Website for any changes to these Official Rules each time they enter the Skill Contest as the Official Rules that apply will be the ones applicable on the day they enter the Skill Contest.
    4. These Official Rules were last updated on 19 June 2024.
  2. The Contest
    1. The title of the Skill Contest is “HiO Golf Limited’s Hole in One Skill Contest”. 
    2. The Skill Contest will run between April 2024 and March 2027 inclusive (the “Contest Term”).
    3. The Skill Contest will take place during daylight hours only at all participating golf clubs  which are listed on our Website (“Golf Clubs”).  The Golf Clubs will ensure the course is set up in line with Sponsor’s guidelines and will have a dedicated par 3 hole set up within the agreed distances set by Sponsor, a minimum of 100 yards and maximum of 200 yards from the tee markers to the hole.
    4. Sponsor will set up a camera dedicated to the Skill Contest at the Golf Club to record the Participants and check on any winners.  The Golf Clubs will allow Sponsor to access the clubhouse CCTV footage if needed to authenticate a Participant’s identity.
    5. Each Participant must be a registered member of a participating Golf Club and eligible to play in the Skill Contest (see clause 3 below).
    6. Each Participant must pay the Entry Fee (defined in clause 6) through the Website when they enter the Skill Contest.
    7. Participants will be able to enter the Skill Contest only once per day during the Contest Term as described in clause 4 below.  Participants cannot purchase additional entries at any time during the same day at any participating Golf Course; and a Participant who has paid for a monthly subscription will not be able to apply for an extra ad hoc entry on any day during the month(s) that Participant has a subscription.
  3. Eligibility
    1. The Skill Contest is open only to amateur golfers (as defined by England Golf (“EG”) and/or The Royal and Ancient Golf Club of St Andrews in Scotland (the “R&A”) under the “Rules of Amateur Status”) who:
          1. are resident in the UK and are at least eighteen (18) years old
          2. are rightfully engaging in a full round of golf and/or a HiO Golf Ltd Skill Contest for just consideration at a participating Golf Course, and
          3. have never earned a PGA or comparable international professional certification and have never been a Club Professional or Touring Professional (as both terms are defined by EG and/or the R&A).
  4. How to enter and win
    1. To enter, Participants must:
          1. be eligible under clause 3;
          2. pay and receive a verifiable receipt from the Website for a valid Skill Contest entry fee at a participating Golf Course; and
          3. be a member of the participating Golf Course; and
          4. confirm that they are eligible to enter, that they have legal capacity to enter the Skill Contest, that they have read these Official Rules and that they are eligible to claim any prize they may win;

(collectively an “Entry”).

    1. The Skill Contest is only open to Participants who take part during the normal daylight operating hours of a participating Golf Course, excluding days when the course is closed whether due to repair, holiday, or any other reason, and only when Sponsor’s monitoring cameras and equipment are operational and in full working order.
    2. PLEASE NOTE THAT EACH PARTICIPANT MUST USE EQUIPMENT CONFORMING TO EG AND/OR THE R&A SPECIFICATIONS, AND MUST TEE-OFF BETWEEN THE TEE MARKERS IN THE TEE BOX THAT MEET ALL 3 OF THE FOLLOWING CONDITIONS:
          1. PARTICIPANTS ARE NO CLOSER THAN THE TEE MARKERS DESIGNATED FOR SUCH PARTICIPANT’S HANDICAP, AGE, AND GENDER (FOR EXAMPLE, WOMEN MUST TEE-OFF NO CLOSER THAN THE WOMEN’S TEE AT THE HOLE);
          2. PARTICIPANT’S POSITION IS NOT MORE ADVANTAGEOUS OR CLOSER THAN THE TEE MARKERS AND TEE BOX FROM WHICH PARTICIPANT HAS BEEN CONSISTENTLY TEEING OFF DURING PARTICIPANT’S CURRENT ROUND (FOR EXAMPLE, MEN PLAYING FROM THE LONGER MEN’S TEE CANNOT MOVE UP TO THE SHORTER MEN’S TEE AT THE HOLE); AND
          3. PARTICIPANTS  ARE IN ANY EVENT LISTED ON THE SCORECARD AS NO CLOSER THAN 115 YARDS FROM THE HOLE FOR MEN, AND 100 YARDS FROM THE HOLE FOR WOMEN. PARTICIPANT MAY NOT MOVE OR ADJUST THE TEE MARKERS SET BY A PARTICIPATING GOLF COURSE.
    3. After Entry, a Participant is limited to one (1) golf swing (the “Shot”) from the appropriate tee box, described in clause 4.3 above, of the hole designated by the participating Golf Course (“Eligible Hole”) at the time of participation, for a chance to hit a hole in one. 
    4. How to play and win the Skill Contest:
          1. A Shot will be deemed to have been taken when the Participant’s golf club comes in contact with his/her ball. No mulligans, practice shots, or substitute shots are allowed (where “mulligan” means (in informal golf) an extra stroke allowed after a poor shot, not counted on the scorecard).
          2. A Shot will only be deemed a potentially winning Shot (“Potentially Winning Shot”), if such Shot is taken between the appropriate tee markers and comes to rest, without any interference of any kind, in the cup of the Eligible Hole (i.e. the ball is “Holed”). 
          3. Holed” is defined as either: (1) for an Eligible Hole, when a ball is at rest in the hole after a stroke and the entire ball is below the surface of the putting green, or (2) for a hole that is modified for COVID-19 or any other safety or precautionary procedures, when the ball is at rest inside the diameter of the hole and any part of the ball is below the surface of the putting green.
          4. Note that if on a Shot, the ball strikes an implement that the Golf Course placed inside the hole in order to prevent the ball from dropping fully below the surface of the putting green for safety reasons (e.g., a piece of foam placed in the bottom of the hole, the hole lining being used upside down, etc.) and the ball’s final resting location is outside of the hole, the Shot will not count as Holed and is explicitly not a Potentially Winning Shot.
          5. All determinations of whether a Shot is Holed and/or a Potentially Winning Shot shall be determined by Sponsor in its sole discretion.
    5. Sponsor reserves the right to refuse a Participant’s Entry or to disqualify an Entry for any reason including the following:
          1. if they have reasonable grounds for suspicion that a Participant is in breach of these Official Rules, in which case Participant will forfeit any refund of the Entry Fee;
          2. the Sponsor reserves all rights to disqualify a Participant if their conduct is contrary to the spirit or intention of the Skills Contest, including if any Participant or party that is present with Participant is found tampering with, hacking, cheating, or abusing any aspect of Sponsor’s operating or monitoring systems, or equipment, or whom Sponsor believes to be causing, with or without intent, any malfunction, error, disruption, damage to the Sponsor equipment and/or system, or attempting to create an unfair advantage for Participant, such Participant and such party that is present with Participant will automatically be disqualified and may be subject to prosecution under law and banned from any future events/competitions in which case Participant will forfeit any refund of the Entry Fee ; or
          3. if it becomes aware, in its sole discretion, of any malfunction of its video system. In such event, Sponsor’s sole liability to Participant will be a refund of the Entry Fee in Sponsor’s sole discretion.
    6. Not all rounds at a participating Golf Course may be eligible for the Skill Contest. One round’s eligibility at a course shall not be an indication that future rounds at the same course will be eligible. For more details, ask the participating Golf Course whether or not your specific round is eligible.
    7. By participating in this Skill Contest, you hereby agree that all interpretations shall be subject to the EG and/or the R&A Rules of Golf available at englandgolf.org /randa.org.
    8. No Participant, Witness (as defined in clause 5 below), or other party may do anything that obstructs or affects or could obstruct or affect the travel or course of the ball being played by the Participant. Any attempt to obstruct or affect the travel or course of the ball will be considered a violation of these Official Rules and the Participant shall be deemed ineligible to receive any prize and shall forfeit their Entry Fee.
  1. How to Claim a Prize
    1. In the event that a Participant hits a Potentially Winning Shot, the Participant must notify Sponsor/HiO Golf Ltd via email to the following address info@hiogolf.com on the same day. Sponsor is not responsible or liable for any delay in, or late, lost, misdirected or unsuccessful efforts to provide notice to Sponsor.
    2. Sponsor will then provide the Participant with information about the paperwork they will be required to provide to Sponsor in order to claim a prize, which can be found at https://hiogolf.com/claim-forms (the “Winner’s Claim Form”). The Participant will have five (5) days from the date of their Potentially Winning Shot to submit the completed Winner’s Claim Form to the Sponsor or the prize will be forfeited.
    3. As stated on the Winner’s Claim Form, Participant must provide HiO Golf Ltd with the names of any parties that are at least eighteen (18) years old, that were present and witnessed the Potentially Winning Shot (individually a “Witness” and, collectively, the “Witnesses”), and Participant and each Witness must endorse the score card for the round of golf in which the Potentially Winning Shot was made. Participant must preserve this score card and submit it to Sponsor upon request. 
    4. Within three (3) days of the Potentially Winning Shot, Participant must provide to Sponsor the: (i) Winner’s Claim Form; (ii) the endorsed score card signed by the Participant and Witness(es); (iii) receipt for a valid Contest entry fee; and (iv) a legible copy of their valid, UK passport or Driving Licence.  If a Participant  cannot verify their age or identity, then they may be disqualified from winning a Prize.
  2. Entry Fee, Prizes and Rights Release
    1. Entry fees are required to be paid in advance through the Website before a Participant attempts the Skill Contest.  The single entry fee is £10 and the monthly subscription entry fee is £19.99 (see clause 7 below); these fees are the same in all participating Golf Courses (the “Entry Fee”).
    2. The prize for a Winning Shot in the Skill Contest will be stated on the Website and at the participating Golf Course at the time of entry (the”Prize”).
    3. The Prize is non-transferable. All Prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion.
    4. Delivery of a Prize will be via BACs or Cheque and will only be to the verified Winner’s physical mailing address (no P.O. Boxes) OR bank account in the Participant’s name. The physical mailing address that the Prize is sent to must be the same used at the time of submission of the Winner’s Claim Form.
    5. A Prize will be delivered within sixty (60) days after the date Sponsor’s verification procedure (see clause 7) is completed and the exact date is to be determined by Sponsor.
    6. PARTICIPANT HEREBY ACKNOWLEDGES THAT HE/SHE IS BEING VIDEOTAPED AND MONITORED BY HIO GOLF LTD’S SYSTEMS, and that Sponsor shall own all pictures, film, and references captured by its video monitoring system.
    7. Participant hereby releases and consents to Sponsor’s use of Participant’s image, likeness, and information for whatever purpose it desires in conjunction with the marketing and promotion of Sponsor (unless prohibited by law).
    8. In particular, the Participant, by participating in this Skill Contest, consents and hereby ,  agrees that the Sponsor may, in their sole discretion, make Participant’s Entry available on its Website  and in any other media, whether now known or invented in the future, and in connection with any publicity of the Sponsor and/or the Skill Contest.
    9. Participants further understand and agree that Sponsor may edit, modify and/or use any such likeness or image as Sponsor deems appropriate. Each Participant agrees that he/she will make no monetary or other claim against Sponsor for the use of, or in relation to, the use of such name, image and/or likeness. In addition, Participants hereby waive any right to inspect or approve any finished material or publication, including, but not limited to, written copy, wherein any such name, image or likeness appears.
    10. A Participant who is a winner hereby understands and acknowledges that once released by Sponsor, including as part of any legally required winner’s list, winner’s name, image or likeness may be used by a third party(ies) and that Sponsor will have no control over such use by such third party(ies). Each Participant agrees to hereby hold harmless and release “Released Parties” (as defined below) from all claims, demands and causes of action which winner, his/her heirs, representatives, executors, administrators or any other persons acting on winner’s behalf or on behalf of winner’s estate have or may have by reason of this authorisation.
    11. Any materials advertising the Skill Contest (“Advertising”) are for illustrative purposes only and are not indicative of actual Skill Contest availability or Skill Contest details. In the event of a conflict between any Advertising and these Official Rules, these Official Rules shall govern.
    12. If a Participant objects to any or all of their surname, county and winning image being published or made available, they should contact the Promoter at chris@hiogolf.com. In such circumstances, the Promoter may still be required to provide the information and winning Entry to the Advertising Standards Authority or such other authority on request.
  3. Monthly Subscription
    1. A Participant can sign up for a monthly subscription to be a Participant through the Website.
    2. The conditions for a monthly subscription are:
          1. the Participant complies with the terms of clause 4;
          2. the Participant signs up, through the Website, to pay a monthly subscription fee of £19.99 in advance of each month in which the Participant wishes to play in the Skill Contest;
          3. the Participant is then allowed to play in the Skill Contest once per day at any participating Golf Course during that month.
    3. The subscription is only available to be used by the Participant who has registered; should any other person use it, the subscription will be terminated and the Entry Fee paid in advance will be non-refundable.
    4. A Participant who has signed up for a monthly subscription cannot apply for any extra attempts at the Skill Contest during any month of the subscription; if they do so, this will be a breach of these Official Rules, their monthly subscription will be terminated and their Entry Fees will not be refunded.
    5. The subscription will continue each month provided that it is not cancelled or terminated and the Entry Fee is paid in advance.
    6. Should a Participant wish to cancel their monthly subscription, they may do so by notifying Sponsor and then their subscription will end one week later, or at the end of the month that they notify Sponsor, whichever is earlier.  Any Entry Fees for that month will not be refunded, but no further Entry Fees will be taken for the following month(s).
  4. Verification Of Winner
    1. All Potentially Winning Shots are subject to verification of eligibility before a prize can be awarded. You can only be verified as a winner by Sponsor. Any information you receive from a participating Golf Course is not confirmation of winning.
    2. If any potential winner is ineligible, the prize or prize notification is not deliverable, the potential winner is not in compliance with these Official Rules, if the potential winner does not return the Winners Claim Forms or other required documents within the required number of days, if a winner cannot be verified, or if a winner is otherwise unable or unwilling to accept and claim the prize as stated, then the potential winner may be disqualified and the prize may be forfeited in Sponsor’s sole discretion.
    3. Neither Sponsor nor participating golf courses are or shall be responsible or liable for late, lost, misdirected or unsuccessful efforts to notify the potential winner(s).
    4. Subject to clause 6.8, participation in the Skill Contest constitutes each winner’s consent to Sponsor and participating Golf Course’s use of winner’s name and likeness, for advertising, promotional, and other purposes in any manner, in any and all media, now known or hereinafter devised, worldwide, in perpetuity, without further payment or consideration, notification, or permission (unless prohibited by law), and by participating in the Skill Contest, you further agree to execute any specific consent needed or requested by Sponsor, participating Golf Courses or their respective designees in furtherance of such use.
    5. Upon receipt of all documents listed in clause 5.4 above, Sponsor shall have a period of thirty (30) business days to investigate and verify the Potentially Winning Shot.
    6. As a condition to claiming the Skill Contest prize, Sponsor may require the Participant to make him/herself and the Witness(es) available for questioning by Sponsor at a time and place reasonably convenient to both Sponsor and the Participant or Witness.  Further, it shall be the Participant’s sole responsibility to cause any Witness required to submit to such questioning by Sponsor.
    7. Sponsor shall be afforded more than thirty (30) days to conduct this verification process if its video equipment has malfunctioned or suffers from other errors or glitches subsequent to the Potentially Winning Shot, or if more time is reasonably needed to question or examine Participant and/or Witness(es).
    8. Sponsor reserves the right, in Sponsor’s sole discretion, to deny a Prize based on any facts reasonably calling the validity of the Participant’s winning claim into question. In the event that a Prize is denied in good faith, including, but not limited to, the malfunctioning of equipment or lack of credible Witnesses, Sponsor shall issue a refund of the Participant’s Entry Fee and shall have no further obligation or liability to the Participant whatsoever.
    9. Potential winners who do not provide the required information, or do not abide by these Official Rules or other instructions of Sponsor may be disqualified at Sponsor’s sole and absolute discretion.
  5. Limitation of Liability
    1. YOU ACKNOWLEDGE AND AGREE THAT PARTICIPATION IN GOLF IS A POTENTIALLY STRENUOUS ACTIVITY AND PRESENTS RISK OF PROPERTY DAMAGE, PERSONAL INJURY AND DEATH. YOU HAVE VOLUNTARILY ELECTED TO PARTICIPATE IN THE ACTIVITIES ASSOCIATED WITH THE SKILL CONTEST WITH KNOWLEDGE OF THE DANGERS INVOLVED, AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF PROPERTY DAMAGE, PERSONAL INJURY, AND DEATH. YOU DO HEREBY WAIVE, RELEASE, AND DISCHARGE RELEASED PARTIES FROM ANY AND ALL LIABILITY FOR PROPERTY DAMAGE, PERSONAL INJURY, AND WRONGFUL DEATH, AND CLAIMS OF ANY NATURE WHICH MAY HEREAFTER ACCRUE TO YOU OR YOUR ESTATE AS A DIRECT OR INDIRECT RESULT OF YOUR PARTICIPATION IN THE SKILL CONTEST.
    2. Insofar as is permitted by law, the Sponsor and participating Golf Clubs will not in any circumstances be responsible or liable to compensate the Participant or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the Skill Contest or taking up the Prize except where it is caused by the negligence of the Sponsor, the Golf Club or that of their employees. Your statutory rights are not affected.
    3. Nothing in these Official Rules limits any liability which cannot be legally limited, including liability for:
          1. Death or personal injury caused by negligence;
          2. fraud or fraudulent misrepresentation.
  6. Data protection and publicity
    1. All Participants are automatically entered into Sponsor’s database for the purpose of conveying information as to the status of their Skill Contest Entries, as well as any future competitions offered by Sponsor.
    2. The Sponsor will only process a Participant’s personal information as set out in the privacy policy [LINK TO PRIVACY POLICY]. See also clauses  6.6 – 6.12 inclusive and 8.4, with regard to the publication of Competition results and announcement of winners.
  7. General
    1. Sponsor reserves the right to modify, suspend, cancel, or discontinue any Skill Contest at any time for any reason, including without limitation to comply with applicable laws, rules, and regulations, and to take any actions Sponsor deems necessary, in its sole discretion, to protect its participating golf courses, or if any virus, bug, technical failures, unauthorised human intervention or other causes beyond Sponsor’s control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Skill Contest. Sponsor reserves the right to correct clerical or typographical errors in promotional materials, including without limitation these Official Rules. Sponsor shall not be responsible to any participant if for any reason the Skill Contest is unavailable at any course at any time (including, without limitation, after the entrant has paid his/her green’s fee but before the entrant has taken a Shot at the Eligible Hole).
    2. If there is any reason to believe that there has been a breach of these Official Rules, the Sponsor may, at its sole discretion, reserve the right to exclude a Participant from participating in the Skill Contest.
    3. All intellectual property rights arising in our Website, the Skill Contest and related documents shall be owned by HiO Golf Limited.
    4. Sponsor may at any time assign, delegate or transfer all of its rights and obligations under these Official Rules to any third party who acquires all or substantially all of the assets of Sponsor.
    5. The failure of either party to insist on the performance of any of these Official Rules, or the waiver of any breach of these Official Rules, shall not be construed as a waiver of the term(s) or condition(s), and the term(s) and condition(s) shall continue and remain in full force and effect as if no forbearance or waiver had occurred.
    6. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
    7. These Official Rules shall constitute the entire understanding between the parties with regard to the subject matter discussed herein. Any prior written or oral or contemporaneous oral representations shall not be binding on either party except to the extent expressly and specifically stated in these Official Rules.
    8. These Official Rules  shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
